Clear expectations for using Baby Brief.

Baby Brief is operated by Ryan Youngdale, a sole proprietor doing business as Baby Brief (“Baby Brief,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern the Baby Brief iOS app, private caregiver handoff website, getbabybrief.com, and related services (collectively, the “Service”).

By creating an account, accepting these Terms in the Service, opening a private handoff, or otherwise using the Service, you agree to these Terms and acknowledge the Privacy Policy. Care and health information is also governed by the Consumer Health Data Privacy Policy and separate in-app permission choices. If you do not agree, do not use the Service.

Eligibility and authority

You must be at least 18 years old and legally able to agree to these Terms. A parent, legal guardian, authorized household member, paid caregiver, babysitter, nanny, or other adult caregiver may use the Service for legitimate household care coordination. If you enter, access, or share information about a child or another person, you represent that you have authority to do so and will use it only for the authorized care purpose.

Accounts and private access

You are responsible for activity through your account and for protecting your device, sign-in credentials, and private handoff links. A caregiver link is a bearer credential: anyone who receives a valid link may be able to access the information made available through it. Do not forward a link beyond its intended recipient or post it publicly.

Ending or revoking a handoff stops ongoing caregiver access but does not erase information already downloaded or independently saved. Previously issued signed image links may remain usable until they expire. Account deletion, care-information deletion, handoff history, and consent withdrawal operate as described in the Privacy Policy and Consumer Health Data Privacy Policy.

Care information, permissions, and emergencies

Baby Brief is an organization and communication tool. It does not provide medical advice, diagnosis, treatment, professional childcare judgment, emergency monitoring, or a guarantee that information, messages, or alerts were received or acted upon. Verify important instructions directly with the responsible adult. Do not rely on Baby Brief for emergencies, time-critical safety decisions, or as the sole record of medication, allergies, medical conditions, or other critical information.

The Service separately requests permission to collect, store, and use potentially sensitive care information and permission to share selected information with caregivers when those choices are required. Agreeing to these Terms is not a substitute for those permissions. In an emergency, call the appropriate emergency number and follow qualified medical guidance.

Your content

You retain your ownership rights in content you submit. You give Baby Brief a limited, non-exclusive license to host, store, process, reproduce, transmit, and display that content only as reasonably necessary to provide, secure, maintain, troubleshoot, and support the Service and the sharing you request. This license does not permit us to publicly advertise, sell, or independently commercialize private household content.

You are responsible for the accuracy, completeness, lawfulness, and appropriateness of your content; for obtaining required permissions; and for keeping independent copies of information important to you. Feedback or product suggestions may be used to improve Baby Brief without an obligation to compensate you, but this does not apply to private care content.

Acceptable use

You may not:

• access, disclose, sell, or exploit another household’s information without authorization;
• sell or transfer an account, caregiver link, or access credential;
• use the Service to harass, impersonate, defraud, or send unlawful or unsolicited communications;
• bypass access controls, interfere with security or availability, introduce malicious code, or test vulnerabilities without written authorization;
• scrape, copy, reverse engineer, or create derivative works from the Service except where applicable law expressly permits it; or
• upload unlawful, harmful, infringing, or intentionally deceptive content.

Authorized paid caregivers may use Baby Brief for the household care they are engaged to provide. That permitted use does not authorize resale of the Service or commercial use of household information.

Subscriptions and App Store billing

Baby Brief may offer monthly and annual auto-renewable subscriptions through Apple’s App Store. Available products, prices, currency, billing period, and any introductory offer are displayed by Apple before purchase. An eligible annual product may include a 14-day introductory trial only when Apple presents that offer to the purchaser; eligibility is determined by Apple and is not promised to every new user.

Payment is charged to the purchaser’s Apple Account at confirmation. A subscription automatically renews unless canceled through Apple at least 24 hours before the end of the current period, subject to Apple’s rules. Manage or cancel it in Apple’s subscription settings. Deleting the app, a Baby Brief account, or household information does not cancel an Apple subscription. Refund requests are handled by Apple under Apple’s policies.

A paid subscription covers the purchaser’s current Baby Brief household. Caregivers using a shared handoff link do not need a separate subscription. If the purchaser changes households, the subscription follows the purchaser; the former household receives the implemented seven-day transition period. A second purchaser household transfer within 30 days may be held until the cooldown ends. Household membership changes affect access but do not themselves delete care records.

Optional text alerts

Caregiver SMS alerts are optional and require the caregiver’s separate affirmative opt-in. Message frequency varies, and message and data rates may apply. Consent is not a condition of purchase. Delivery depends on carriers, devices, connectivity, and service providers and is not guaranteed. Do not rely on an alert for urgent communication. Our service and intellectual property

Subject to these Terms, Baby Brief grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended household-care purpose. The Service, software, design, branding, and materials supplied by Baby Brief are owned by Baby Brief or its licensors and are protected by applicable law. No other rights are granted.

If you believe material available through the Service infringes copyright, email support@getbabybrief.com with enough information for us to identify the work, material, location, your contact information, and the basis of your good-faith claim. Baby Brief has not designated a registered DMCA agent.

Apple terms

The Apple Standard Licensed Application End User License Agreement applies to the iOS app unless Apple requires otherwise. Apple is not responsible for operating, maintaining, or supporting Baby Brief or for addressing claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable Apple-related provisions against you. Your use must comply with Apple’s applicable rules.

Third-party services

The Service depends on Apple and other providers and may link to third-party services. Their availability and handling of information are governed by their own agreements and notices. Baby Brief is not responsible for third-party services outside our reasonable control, but this does not limit obligations that applicable law places on us.

Availability, security, and data loss

The Service may be unavailable, delayed, interrupted, changed, or discontinued. Information may become unavailable, incomplete, delayed, lost, corrupted, altered, or accessed without authorization because of device failure, connectivity, third-party services, software defects, human error, or other events. Maintain independent records of important care information. Nothing in these Terms removes any duty to provide notice of a security incident when required by law.

Suspension, termination, and deletion

You may stop using the Service at any time. We may restrict or suspend access when reasonably necessary to protect a family, another person, the Service, or its security; comply with law; or address a material violation of these Terms. Where practicable, we will give notice and an opportunity to resolve the issue.

Deleting an account is separate from canceling an Apple subscription. Shared household records may remain for other authorized members, and provider or backup cleanup may take additional time as described in the Privacy Policy. Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, dispute provisions, and these survival terms—will survive.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BABY BRIEF DISCLAIMS WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND NON-INTERRUPTION. WE DO NOT WARRANT THAT THE SERVICE WILL PRESERVE DATA, BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BABY BRIEF AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PRIVACY, GOODWILL, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABY BRIEF’S AGGREGATE LIABILITY TO YOU FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID FOR BABY BRIEF THROUGH THE APP STORE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These exclusions and limits do not apply to death or personal injury caused by our negligence, fraud, intentional misconduct, gross negligence, remedies or liabilities that cannot legally be limited, mandatory consumer or data-protection rights, or applicable refund rights. Some jurisdictions do not permit certain limitations, so they apply only to the extent lawful.

Indemnity

To the extent permitted by law, you will indemnify and hold Baby Brief harmless from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful content, deliberate unauthorized access or disclosure, material violation of these Terms, or violation of another person’s rights. This does not require indemnification for Baby Brief’s own negligence, unlawful conduct, or responsibilities that cannot be shifted under applicable law.

Governing law and disputes

Texas law governs these Terms, without regard to conflict-of-law rules, except where mandatory law in your jurisdiction provides otherwise. A dispute not resolved informally will be brought in the state courts located in Williamson County, Texas, or a federal court with jurisdiction over Williamson County. You and Baby Brief consent to that jurisdiction and venue. This paragraph does not prevent either party from using an eligible small-claims process or seeking urgent injunctive relief, and it does not waive a venue, consumer, or privacy right that applicable law does not permit you to waive.

Changes to these Terms

We may update these Terms when the Service or applicable law changes. We will post the revised Terms and identify their effective date. For material changes, we will provide email or prominent in-service notice and reasonable advance notice where practicable, and the app may require fresh acceptance before continued use. Urgent security, abuse-prevention, or legal changes may take effect sooner where permitted. Changes do not remove rights that applicable law does not allow us to remove.

General terms

If part of these Terms is unenforceable, the remaining provisions remain effective and the affected provision will be enforced to the greatest lawful extent. A failure to enforce a provision is not a waiver. You may not assign your account or these Terms without our consent. We may assign these Terms in connection with a reorganization, financing, merger, acquisition, or sale, subject to applicable law. These Terms, the policies linked above, Apple’s applicable terms, and any purchase terms shown at checkout form the agreement governing the Service.
