Clear expectations for using Baby Brief.

Baby Brief is operated by Ryan Youngdale, sole proprietor (“Baby Brief,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern the Baby Brief iOS app, private caregiver handoff website, getbabybrief.com, and related services (collectively, the “Service”). By downloading, accessing, opening a private handoff, or using the Service, you agree to these Terms and the Privacy Notice. If you do not agree, do not use the Service.

Eligibility and authority

You must be legally able to agree to these Terms. If you use the Service for a child or household, you represent that you have authority to enter, use, and share the information you provide. Parents and guardians are responsible for deciding what child information to include and who receives access to a handoff. A caregiver may use a private link only for the intended handoff and only while access remains active.

Limited license and ownership

Subject to these Terms, Baby Brief gives you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended household-care purpose. The Service, its software, design, branding, and other content are owned by Baby Brief or its licensors and are protected by applicable law. Except for this limited license, no rights are granted to you.

Your content and responsibilities

You retain your rights in the information and content you submit to the Service. You give Baby Brief the limited permission needed to host, process, reproduce, transmit, and display that content solely to operate, secure, support, and improve the Service for you and the people you authorize. You are responsible for the accuracy, completeness, and lawfulness of your content, for obtaining any required permissions from other people, and for keeping independent copies of information important to you.

Care information and emergencies

Baby Brief is an organizational and communication tool. It does not provide medical advice, childcare advice, professional judgment, monitoring, emergency response, or a guarantee that a message or alert was received or acted upon. Do not rely on Baby Brief for an emergency, time-sensitive safety decision, or as the sole record of medication, allergy, medical, or other critical care information. In an emergency, call the appropriate emergency number and follow qualified medical guidance.

Accounts, private links, and acceptable use

Keep your account credentials, device access, and private handoff links secure. Do not forward a private link beyond its intended caregiver, post one publicly, or attempt to access another family’s information. You may not misuse the Service; interfere with security or availability; bypass access controls; upload unlawful, harmful, or infringing material; impersonate another person; scrape or reverse engineer the Service except where the law permits; or use the Service to send unsolicited or unlawful messages.

Optional RCS and SMS alerts

Caregiver alerts are optional and require the caregiver’s express opt-in. Message frequency varies, and message and data rates may apply. Delivery depends on carriers, devices, connectivity, and service providers and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages. Availability, data loss, and security incidents

The Service depends on your device, network, Apple, and other providers. It may be unavailable, delayed, interrupted, changed, or discontinued. Information may be unavailable, incomplete, delayed, lost, corrupted, altered, or accessed without authorization because of device failure, connectivity issues, third-party services, software defects, human error, or other events. You are responsible for maintaining independent records of any information that is important to you. Nothing in these Terms removes any obligation we may have to provide notice of a security incident when required by applicable law.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BABY BRIEF DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND NON-INTERRUPTION. WE DO NOT WARRANT THAT THE SERVICE WILL PRESERVE DATA, BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BABY BRIEF AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PRIVACY, GOODWILL, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BABY BRIEF’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain exclusions or limitations, so these provisions apply only to the extent permitted by law and do not limit rights that cannot lawfully be limited.

Indemnity

To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless Baby Brief and its providers from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your unauthorized use of the Service, or your violation of these Terms or applicable law.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe it is necessary to protect families, the Service, or others, or if you violate these Terms. Sections that by their nature should survive termination, including ownership, disclaimers, limitations of liability, indemnity, and this section, will survive.

Apple platform terms

If you downloaded the app through Apple’s App Store, Apple is not responsible for providing maintenance or support for the app or for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with Apple’s applicable usage rules.

Changes and contact

We may update these Terms as the Service or applicable law changes. We will post the revised Terms here and update the effective date. If a change is material, we will provide additional notice when required by law. Continued use after the effective date means you accept the revised Terms to the extent permitted by law.
